Supreme Court (SC) on Sunday ruled that the implementation of the republic was not against the interim constitution. Giving its verdict to the case filed by advocate Ram Kumar Ojha challenging the constitutionality of the Constituent Assembly where 26 CA members are to be nominated by the government.
Quashing the writ petition, a single bench of Justice Damodar Prasad Sharma said the implementation of republic could not be delayed even in the absence of 26 members as the delay could affect other articles of the constitution.
Advocate Ram Kumar Ojha representing Nepal Janata Dal had filed the petition on June 2 in the SC demanding annulment of the CA implementation.
Abolishing the 240-year old monarchy, the first sitting of the CA on May 28 had declared the country a 'federal democratic republic'.
